August 23, 2004 - Stephanie Canterbury asks what to do with an offender who has an authorization to use medical marijuana. The offender is obtaining plants from Green Cross but does not have a "terminal or debilitating illness". Sent to Lori Ramsdell-Gilkey for feedback. - [2:108-109]

August 1, 2005 - Department of Corrections Form: Community Custody Hearing Report Non-Contested. Kitsap County. Manufacture of methamphetamine and manufacture of marijuana. The offender plead guilty to DOC violations over positive drug tests. He says he's a qualified medical marijuana patient after a 1997 motorcycle accident. Hearing Officer Paul Ockerman orders him to attend chemical dependency treatment. (Cause # 02-1-01067-7) - [2:114-116]

August 2, 2005 - Email Discussion between Lori Ramsdell-Gilkey and Paul Ockerman about the offender who was ordered to attend chemical dependency treatment the day before. - [2:113]

November 16, 2005 - Court of Appeals in Oregon ruling against a medical marijuana patient who filed suit after having his medical marijuana card taken away as a condition of probation. - [1:567-569]

November 16, 2006 - DOC Form requesting clarification from Judge George L. Wood in Clallam County on an offender's right to use medical marijuana. The offender is serving a sentence for manufacture of methamphetamine and marijuana and is under supervision in Spokane. (Cause # 02-1-00251-9). On July 17, 2008, Judge Wood rules in favor of the offender, saying that "the limited circumstances of medical use of marijuana by Def. is not "illegal" and not a violation of community custody. - [1:291][1:722][2:130]

November 17, 2006 - CCO Amy Baddgor asks about DOC's stand on medical marijuana. In a part that's mistakenly left unredacted in only the first link (page 2:16), she notes that in 2000, the AG's office stated that they accept a medical marijuana card as a valid prescription, but that it's not a civil rights violation to stipulate that an offender not be allowed to possess/use it. John Degroat forwards to Mike Dodds saying that they're starting to see a lot more people with medical marijuana authorizations. Clark County Prosecuting Attorney Philip Meyers tells DOC that they need to clarify their policy and hints that the doctors prescribing marijuana would be afraid to testify in court under oath. - [2:16][2:77][2:134-140]

November 22, 2006 - Several DOC employees forward along a State Supreme Court decision released on the same day that ruled against a medical marijuana patient who was arrested in 2003 in Washington but only had authorization from California and Oregon. - [2:88-98]

December 19, 2006 - Peter Gerstenberger asks for clarification on the latest DOC position on medical marijuana. One of his offenders says he obtained a medical marijuana authorization from Seattle-area doctor, but failed to meet with Gerstenberger with the paperwork. The offender is supposed to be taking mental health medications and is considered dangerous. - [2:75-76]

January 31, 2007 - An inquiry from CCS David Phillips about medical marijuana policy. Sandy Robertson replies that Anne Fiala relayed that the offender must have a doctor's prescription and that the sentencing court must approve it. This was in reference to an offender who was intending to use methadone and medical marijuana upon release. - [2:74][2:82-83]

February 6, 2007 - Offender being handled by Anne Fiala, who planned to be released to an address in Airway Heights (near Spokane), will not be allowed to live at the address because the person at that address (his father) is opposed to his desire to use medical marijuana and methadone. - [2:80-81]

February 7, 2007 - Donna Cayer asks Eleanor Vernell about offender in Tacoma (CCO Donovan Russell) who is using medical marijuana. She asks "How do we go about the decision to deny it". - [2:102-103]

March 8, 2007 - Linda Tolliver and David Phillips discuss how to inform an offender of the conditions of his probation, including requiring a prescription to use medical marijuana and travel restrictions to Pierce County. - [2:73]

March 20, 2007 - Medical marijuana authorization form from Dr. Thomas Orvald. This is for the offender (born in 1960) who'd hoped to be released to Airway Heights, but whose father was opposed to the placement. - [2:131]

May 1, 2007 - Larry Tornquist sends out information about how to correctly read urinalysis results. - [2:121-122]

May 9, 2007 - CCO Joel Eskes reports that an offender under supervision is refusing to take drug tests and plans to get a medical marijuana authorization. Ida Leggett spoke with the AAG to get a legal opinion at around the end of that same month. In a follow-up on July 26, 2007, Robert Pearson says that the offender has an "entrenched cocaine abuse problem" and takes lithium for his mental health condition (he put lithium in quotes for some reason). - [2:99-101][2:118-120]

May 10, 2007 - Rebecca Anderson informs CCO Kathy Gardner that the DOC does not recognize the medical marijuana card if the offender has a no use condition. - [2:79]

June 14, 2007 - CCS Jeffery Frice sends out confirmation that the hearings unit will not recognize medical marijuana as a valid prescription - [2:78]

June 25, 2007 - CCS Tracy Grunenfelder forwards along the concerns of an unnamed CCO who doesn't know what the policy is regarding medical marijuana and is finding that different people within DOC have different interpretations of the law. Armando Mendoza asks Lori Ramsdell-Gilkey if they've heard from AG. - [2:117]

July 12, 2007 - An AAG Advice Memorandum is received by the DOC. Lori Ramsdell-Gilkey distributes the file within the DOC saying that the affirmative defense of the medical marijuana law does not apply to administrative disciplinary hearings. Ramsdell-Gilkey's summary of the AAG's reasoning is redacted from the mail. On April 17, 2008, in response to being contacted (see April 15, 2008) by AP reporter Gene Johnson, Mac Pevey forwards this email to Assistant Secretary of the CCD Karen Daniels, who then sends it to Dr. Marc Stern and Scott Blonien in order to come up with a statewide process. Scott Blonien has concerns that the policy being based on the AAG Advice Memorandum is too harsh (he asks "Do we really want to die on this hill?") and proposes a better system which he refers to as the "Stern Plan", where Dr. Marc Stern will advise the DOC on whether or not the patient has a legitimate medical use defense. - [1:77-84][1:234][1:680-685][2:469-470]

July 16, 2007 - Marjorie Littrell asks Lori Ramsdell-Gilkey about the medical marijuana policy. Littrell believed that the sentencing court had to approve it and that there was only a single doctor who was allowed to authorize it. - [2:110]

November 6, 2007 - DOC Health Services RN Heidi Bale sends out an email saying that Dr. Thomas Orvald is "handing out "prescriptions" for medical marijuana". Gregg Freeman responded saying that he spoke with several pharmacies and found that you can't get medical marijuana from a pharmacy, only Marinol. - [2:123-124][2:141][3:115-116]

January 2, 2008 - Port Angeles attorney Paul Richmond sends a letter to DOC informing them that his client, who was wounded by a firearm as a minor, has a right to use medical marijuana under the law for his chronic pain. - [2:132-133]

January 2, 2008 - Travis Hurst asks if Marinol is legal and if offenders can take it if prescribed. Aaron Cole responds that it's ok with a valid prescription from a "real" doctor. Carl Taylor says it's ok unless the AG says otherwise. Michael Curran asks Debra Conner what the AG's thoughts would be. Marjorie Littrell confirms that it's allowed with a prescription, but must be indicated on the urinalysis form. January 3, 2008 - Jeri Boe emails Armando Mendoza asking about an offender with a medical marijuana authorization who contacted an attorney (see January 2, 2008). Lori Ramsdell-Gilkey asks what happened to the Special from November 2006 (see November 16, 2006). Boe responds that the judge never made a ruling. Ramsdell-Gilkey says that his medical marijuana use isn't allowed unless approved by a judge. Jon Krause sets up a court date on February 15, 2008(Cause # 02-1-00251-9) - [2:111-112][2:128-129]

January 23, 2008 - Dan Judge from the Attorney General's office forwards an email to Eldon Vail and Mary Leftridge Byrd at the DOC. Scott Blonien (then with the AG's office) and Paul Weisser (also in AG's office) are cc:ed. Contents of email, including subject and attachment file names) are redacted. February 5, 2008 - Douglas Hiatt sends an email to Dan Judge and Paul Weisser about Thurston County offender (CCO Mary Captain) who was paralyzed from the chest down in a 2004 car accident. - [1:708]

February 7, 2008 - Donna Cayer asks Eleanor Vernell about Tacoma offender (see January 30, 2008) and how to determine if a legitimate need for medical marijuana exists. Mary Leftridge Byrd directs Eleanor to call Scott Blonien or Paul Weisser. - [1:515][1:788]

February 13, 2008 - Judyth Lonborg in the Attorney General's office sends Douglas Hiatt a signed letter (pages 2:84-85). Douglas Hiatt responds to Brian Moran in the Attorney General's office on February 22, 2008 saying that the AG's stance is unacceptable. Hiatt then responds to Dan Judge and Paul Weisser that they aren't in a position to second-guess doctors. Moran responds with a desire to look at each case individually. March 9, 2008 - Eldon Vail sends an email to Karen Daniels and Scott Blonien (still with AG's office). He's concerned that CCO's are not getting clear direction on how to deal with medical marijuana authorizations and asks them to figure out how to handle them. - [1:87]

March 17, 2008 - Melissa Leggee from CannaBiogen sends a fax (page 1:231) to Alex Othon at the DOC informing him that they are violating state law by preventing their patient from using medical marijuana. The patient is not able to obtain Marinol due to FDA regulations and has already lost 25 pounds since being forced to stop using his medicine. - [1:229-231][1:661-662]

April 14, 2008 - A medical marijuana patient (last name Low - mistakenly left unredacted - residing in Centralia) who was being forced to stop using his medicine (CCO Joice Hagen) writes to Governor Gregoire for assistance. Tracie Schaefer in the Governor's office handled the referral (GOV-1553 - page 1:112). Joice Hagen responds that the offender lost an Out of Custody hearing and that they were imposing the AG's new rule. April 15, 2008 - AP reporter Gene Johnson contacts the DOC about their policy on medical marijuana authorizations. Dr. Marc Stern replies that the policy is to examine medical need on a case-by-case basis. Diane Gozart mentions that there are no meeting minutes on the topic because the meeting minutes are posted online and this is a "touchy topic". April 18, 2008 - CCO Marki Schillinger send a fax to Karen Daniels (Criminal Justice System/Multi-Party Authorization for Release of Information - page 1:732) for a patient of Dr. Scott Havsy of Tacoma. On May 1, Mac Pevey informs Karen Daniels that Dr. Havsy left a voice mail for Marki Schillinger informing her that his patient is within his rights to use medical marijuana to treat his pain. Scott Blonien loops in the Attorney General's office explaining how they can justify overriding that doctor's authorization, suggesting that Havsy might be a "sham" doctor. April 18, 2008 - Steve Hammond sends out FDA information on Marinol to Karen Daniels, Scott Blonien, and Dr. Marc Stern in order to come up with justification questions for medical marijuana use. Karen Daniels wants to put together an Administrative Bulletin to communicate the new policy. Dr. Marc Stern mocked up a consent form. April 21, 2008 - Offender with last name Low from Centralia (see April 14, 2008) sends another letter complaining about his new CCO Matt Franks' behavior and claiming that DOC is not allowing him to take Marinol (DEP-7977 - page 1:113). April 23, 2008 - Chad Lewis announces that Karen Daniels will be the spokesperson for the AP story and that she'll tell the reporter that "DOC is implementing a few guidelines as we prepare a policy". - [1:565]

April 25, 2008 - Sarah Warren sends out a draft of the Governor's alert asking for Karen Daniels to take a look at the medical marijuana piece. Karen Daniels makes unidentified small changes. - [1:669]

May 5, 2008 - Cheryl Strange (sitting in for Dr. Marc Stern) was given approval at an executive staff meeting to finalize and publish the medical marijuana policy. - [1:93-94][1:660]

May 9, 2008 - Maurena Chestnut sends a few documents out to Community Corrections Division Management for feedback. The policy author is listed as Ralph Berthon. Deborah Johnson emails RN Heidi Bale on May 22, 2008 saying that she's surprised by something in the medical marijuana policy, but she checked with Dr. Marc Stern and it's correct. - [1:160]

May 16, 2008 - Administrative Bulletin AB-08-009 (DOC 380.200) is released. It states that if an offender "requests medicinal use of marijuana", they will get a form that they will give to their physician. The offender's physician will fill out the form and send it to the Director of Medical Services for approval. The Director of Medical Services will inform the CCO of the decision. May 19, 2008 - After receiving the Administrative Bulletin, Vancouver CCS Robert Story emails to say that this is a shift from the previous practice, which was to "follow federal law". He asks if he can violate offenders for using medical marijuana while they're going through the approval process. Scott Blonien responds that "We start from the premise that the use/possession/manufacturing of MJ is illegal". Dr. Marc Stern replies that the patients should have 2 weeks for their doctor to submit paperwork wherein they won't be violated for using their medicine. Karen Daniels asks if it's ok to send out Scott and Marc's conflicting advice to all the Field Administrators. Anne Fiala and Earl Wright point out to her (politely) that that would be stupid and confusing. On May 27, 2008, Karen Daniels asks Donna Cayer for help. Donna Cayer proposes that Dr. Marc Stern's proposal of a 14-day waiting period be adopted and communicated to the FAs. Scott Blonien finds Cayer's proposal wording "confusing". Cayer sends out an update where she specifies that the primary care physician is the one "identified by the offender"). May 19, 2008 - After receiving the Administrative Bulletin, Donald Feist emails Karen Daniels and asks about the term "Primary Care Physician". Feist claims that the majority of the cases (including his own) are coming from Dr. Thomas Orvald, who is not really a primary care physician since people see him specifically for marijuana authorizations. Karen Daniels replies that it doesn't matter who the doctor is, they'll render a decision based upon the completed forms. Dr. Marc Stern agrees. - [1:579][1:658-659]

May 19, 2008 - Medical marijuana authorization form from Dr. Thomas Orvald for patient born in 1975. - [3:197]

May 22, 2008 - An 'Interstate Commission for Adult Offender Supervision' form is filled out for Kathy, a medical marijuana patient who'd been arrested in Arizona and wanted to move to Seattle. Her transfer request was being denied because on a May 21, 2008 visit to the home where she intended to stay, she was living with Carla Cole, a medical marijuana patient who was growing 6-8 plants. Kathy was arrested and taken to King County Jail. CCO Jeremy Praven, who filled out the report, claimed that Kathy has no family ties in Washington and that her medical marijuana authorization "has no validity in the state of Washington". - [2:20-22]

May 22, 2008 - Carla Cole, the woman whom Kathy was staying with (her name is redacted in many places, not sure why), sends an email detailing the rude behavior of the CCOs as they arrested Kathy, copying the Governor's office, several state legislators and the media. A Deputy Secretary's Correspondence Log was opened (DEP-8164 - page 1:133). Cole sends another email detailing how Kathy was arrested in Arizona and clarifies more of what happened during the arrest. On May 26, 2008, Cole writes to DOC alerting them to the fact that Kathy is suffering from pain and high blood pressure. Another Deputy Secretary's Correspondence Log is opened (DEP-8184 - page 1:124). May 28, 2008 - CCO Simon Barr from Ellensburg asks if the medical marijuana policy applies to misdemeanor convictions as well as felonies. May 28, 2008 - Karen Daniels contacts Donta Harper about Kathy's arrest (see May 22, 2008) asking if there's any validity to the allegations of rudeness. Harper cancels the detainer and reveals that they probably shouldn't have detained her in the first place. He notes that when Seattle Police was contacted, even they didn't pursue any arrests. Karen replies that the media may pick up the case. Scott Blonien says that Karen will call to apologize for the situation. Eldon Vail asked Karen Daniels if she was able to verify Carla Cole's accusations of rudeness. Karen Daniels asks Donta Harper about the rudeness question. May 31, 2008 - Another medical marijuana patient who was arrested in Arizona (James?) contacts DOC about being denied medical marijuana use. He's a combat disabled veteran. His CCO is Sean Tuitele in Olympia. - [1:366-368][1:724-726]

June 6, 2008 - Iris Peterson sends out a long list of questions to Scott Blonien on Policy 380.200 and notes that it doesn't address offenders who were using medical marijuana prior to conviction and then get sentenced to community supervision. Ronald Peterson replies that he's not sure, but he thinks that it doesn't matter and that cases should be treated the same regardless of whether or not an offender was using medical marijuana prior to conviction. - [1:272-274][1:553-555][1:617-620]

June 9, 2008 - Legislative aide Bernie Ryan asks Scott Blonien for a specific federal statute or CFR that allows DOC to prohibit medical marijuana use by qualified patients. Blonien replies that there isn't a CFR or federal statute, but that there's a doctor in Bellevue who is allegedly selling the authorizations. Blonien is concerned about possibility of a medical marijuana patient causing a car accident and DOC being liable. He tells Ryan about the internal review process they developed. Legislative aide Ken Camp informs Ryan that AG issued an opinion and that they should probably get their hands on it. Ryan sends that to Blonien, who then asks Paul Weisser at the Attorney General's office. Weisser reminds Blonien that Blonien himself issued the opinion he's now asking about back when he was worked at the AG's office. Weisser recalls that the advice given was to have the offender "sign a release/waiver so that the CCO could check it out with the prescribing physician". Weisser also complains that their memo ended up being leaked to a defense attorney. Weisser then sends out another reply which is mostly redacted. June 18, 2008 - Dr. Steve Hammond denies a physician request for medical marijuana for an offender who suffers from insomnia and muscle spasms. Karen Daniels says she has another case pending. - [1:223][1:410-411][1:559][1:630]

June 19, 2008 - Donna Parsons emails Karen Daniels saying that her department is the correct place for resolving the complaints surrounding Kathy's arrest (see May 22, 2008 and May 28, 2008). - [1:632-636]

June 20, 2008 - Another complaint was made to the Governor regarding the behavior of the CCOs during Kathy's arrests. June 20, 2008 - Donta Harper sends out an email to Todd Johnson and Kimberly Pearson informing them that Kathy's denial of her Interstate Compact was being rescinded and that she'll be able to stay in Washington and submit the forms to use medical marijuana. June 23, 2008 - At the Executive Staff Meeting, Dr. Marc Stern reiterated that it was important for people to follow the new medical marijuana process. - [1:95-96]

June 25, 2008 - Medical Authorization to Possess Marijuana Documentation from Dr. Scott Havsy for patient born in 1977 (see August 13, 2008). - [1:316][3:8-12]

June 25, 2008 - Dr. Steve Hammond was contacted by phone by a medical marijuana patient (name redacted - probably John Worthington) who was the executive directory of a medical marijuana group (also redacted) in Seattle. This was in regard to an offender with Crohn's Disease. Hammond explained to him that they used the FDA's labelling indications for Marinols as their rationale for denying people's rights to use medical marijuana under the state law. He didn't feel comfortable (for good reason) defending this on a legal basis and asked for help from Karen Daniels, Scott Blonien, and Dr. Marc Stern. Dr. Stern said that these issues go to Daniels. - [1:185]

June 25, 2008 - John Worthington leaves a voice-mail for Dr. Steve Hammond. Karen Daniels tells Hammond and Monica Distefano about her own conversation with Worthington. June 25, 2008 - Monica Distefano send Karen Daniels the updated Administrative Bulletin and associated forms. Hearing Officer Gordon Neufield says the the memo "flies in the face of current appeal process" because an offender is approved to use medical marijuana, they have no way to file an appeal. Lori Ramsdell-Gilkey says that the offender would need to "seek relief through a PRP". Hammond replies tp Karen Daniels that the 380.200 document doesn't touch on Marinol, but that there'd be value in having offenders who are prescribed Marinol have to go through the same verification process as for medical marijuana. Hammond then tells Duran that "Terminal cancer would not be considered an appropriate reason for being on Marinol" unless he's undergoing chemotherapy. He has a medical marijuana authorization, but was told by CCO Jodery Goble that it would be very hard to get approval, but he could more easily use Marinol instead. Offender says that Marinol doesn't work as well as marijuana itself. On April 9, 2009, CCO Ronda Nielsen and CCO Goble visited the offender and found marijuana plants where he was living.
